I'm not, not saying that I know something about this, I'm just saying I know that Red Hat has lawyers they have paid off to misconstrue open source licensing to their favor. That's not hard to guess though. At this point yes, they are trying to get away with whatever they can to "legally" not break the letter of the license, while breaking the spirit of the license.

Even if they break the rule and blatantly steal from open source licensed projects, there are not enough recourse to punish them for it. It's a win win win situation for them.
