Isn't this just straight-up bad for the company? Doesn't refusing to participate in arbitration open them up to lawsuits instead, which are more expensive and less favorable to the company?

So he forced the ex-employees into arbitration and now won't pay the arbitration fees. What an asshat. Maybe Twitter will declare bankruptcy once everyone's sued them.
