I don't doubt that is how the current supreme court would interpret it. This approach of asking "how the founding fathers would think" results in exclusion of non-white citizens. On the other hand, lack of atandardized identification documents in the USA result in this mess.
Also the definition of what the founding fathers had of white was extremely different. It was only people from Britain that were white. The English, Scottish, and Welsh. No one else. Not the Germans, Irish, or Swedes even.
Are you under the impression that the founding fathers weren't slave holders themselves?
